Adult Content & Age Policy Clear Boundaries. Responsible Sharing.
Swingers Nights is for adults aged 18 and over. This policy explains our rules for submitted content, age restrictions, consent, permission to publish and reporting concerns.
This policy does not authorise content prohibited by our Community Rules or applicable law. It is not a blanket legal-exemption statement or a certification of regulatory compliance.
1. Adults Only
You must be aged 18 or over to use Swingers Nights. People under 18 must not register, submit content or use member services.
Images or videos depicting anyone under 18 are prohibited on Swingers Nights. Anyone depicted in adult content must have been aged 18 or over when the photograph or recording was created.
Being an adult now does not make an image taken while under 18 acceptable. Do not submit content if you cannot establish that the people depicted were adults at the time it was created.
An age statement in a profile, an uploader’s declaration or an account-verification badge does not establish the age of every person depicted in a particular photograph or video.
2. Consent and Permission to Publish
Only submit photographs, videos and other material that you own or are authorised to publish. Every identifiable person depicted must have agreed to the intended sharing or publication.
- Consent to being photographed or filmed is not, by itself, consent to publication.
- Consent to share material privately is not, by itself, consent to publish it publicly or share it with additional people.
- A private message or privately shared photograph must not be republished without the required permission.
- Content found online is not automatically free to copy, upload or use in event promotions.
- Do not impersonate another person or falsely present someone else’s content as your own.
These rules apply to member submissions where enabled, venue photographs, event promotions and other material provided for use on Swingers Nights.
Permission to upload material does not override another person’s privacy rights, intellectual property rights, our Community Rules or applicable law.
3. Prohibited Content
You must not submit, publish or share the following on Swingers Nights:
- Images or videos depicting anyone under 18.
- Sexualised content presenting someone as under 18, including manipulated or generated depictions.
- Non-consensual intimate images, covert recordings or material shared without the required permission.
- Manipulated or generated intimate depictions of identifiable people without their consent.
- Content depicting sexual abuse, coercion or exploitation.
- Material that infringes another person’s privacy or intellectual property rights.
- Any content prohibited by applicable law or our Community Rules.
Meeting the age requirement does not automatically make an upload acceptable. Other content restrictions still apply.
The availability of an upload, profile or messaging feature does not mean that every type of adult material is permitted.

4. Age and Identity Checks
Follow any age or identity verification instructions applicable to the service you are using.

Do not send identity documents through ordinary email, member messages or a general contact form. Use only the designated process where a check is required.
Account verification is not the same as verifying everyone in an image. A badge or account check does not, by itself, establish the age, identity or consent of every person depicted in a particular photograph or video.

5. UK Age-Assurance Requirements
UK online-safety requirements are separate from the US record-keeping requirements described below.
Where the relevant duties under the UK Online Safety Act apply, services that allow pornography must use highly effective age assurance to prevent children from encountering that content.
An “18+” notice, a date-of-birth entry or a user’s declaration of age does not, by itself, establish compliance with those requirements.
A policy page is not an age-assurance system. This page sets out content rules and explains relevant distinctions. It does not itself carry out an age check or demonstrate that a particular verification method meets regulatory requirements.
The requirements applicable to a service depend on its content, functionality and operating model. Account verification, content moderation and age assurance serve different purposes.

6. US Record-Keeping Requirements
Sections 2257 and 2257A of Title 18 of the United States Code, together with the associated regulations in 28 C.F.R. Part 75, impose identification, record-keeping and disclosure requirements in circumstances specified by those provisions.
Their application depends on the relevant visual depictions, activities and legal definitions. The fact that content is submitted by a user does not, by itself, establish an exemption.
This page is a content policy, not a blanket Section 2257 exemption statement. It is not a records-location disclosure and does not assert that all images or videos on Swingers Nights are exempt.
An adults-only notice, an uploader’s declaration or an account-verification badge is not a substitute for any applicable record-keeping or disclosure obligations.
Any required compliance disclosure must accurately reflect the relevant content, activities and records arrangements. This policy does not replace such a disclosure where one is required.

What to Include in Your Report
- The page URL or location of the content, if available.
- The relevant account, venue or listing name.
- A brief explanation of the age, consent or other content concern.
- Details that help identify the material without copying or redistributing it.
Do not download, copy, forward or attach suspected child sexual abuse material. Do not send passwords or identity documents with your report.
Swingers Nights reserves the right to refuse submissions, remove content or restrict access where this policy or our Community Rules are breached.
If your concern involves material you did not consent to being shared, identify the relevant page or account and explain the concern without attaching additional intimate material.
